According to Oneida County Sheriff's Office Chief Deputy Derrick O'Meara, who is the Director of the Oneida County Child Advocacy Center (CAC), a Level 3 Sex Offender from Lewis County, was arrested by the CAC for failing to meet his obligations as a registered sex offender under the Sex Offender Registry Act (SORA). Under SORA, registered sex offenders are required to notify the NYS Division of Criminal Justice Services (DCJS) of any change of address within ten calendar days of said change. In March of 2025, Sergeant Melissa Bolton, who is assigned at the CAC, commenced an investigation into Level 3 Sex Offender, Dwayne Kirk, age 58, when the Oneida County Sheriff's Office Patrol Division was notified that Kirk was not residing at the address that he had registered with the NYS DCJS. Kirk's address was registered as being in the Town of Western in Oneida County. Upon completion of the investigation, it was learned that Kirk had been residing at an address in Constableville in Lewis County since the end of December 2024. On March 28, 2025, Kirk was located in the Village of Lowville (Lewis County) and taken into custody by Sgt. Bolton and OCSO Inv. Alicia Marconi, who is also assigned at the CAC. The Lewis County Sheriff's Office assisted with this investigation and with the arrest of Kirk. Kirk was charged with one count of Failure to Register Change of Address, a Class E Felony under the NYS Corrections Law.
Kirk was transported to the Kurt B. Wyman Law Enforcement Building where he was processed and later arraigned at CAP Court at the Oneida County Correctional Facility. Upon arraignment, Kirk was remanded to the Oneida County Correctional Facility without bail.
