According to the Oneida County Sheriff Robert Maciol, a City of Utica teen was arrested following a DWI investigation in the Town of Marcy.
On December 7th, 2025, at around 7:10 p.m., the Road Patrol Division was dispatched to the intersection of River Street and Joe Kelly Memorial in the Town of Marcy for a single car property damage accident. Deputies determined Robert Burke, 19, of Utica, NY, was operating a 2024 Mazda in a northbound direction on River St., and due to unsafe speed, he failed to stop at the stop sign causing the vehicle to strike a street sign before coming to rest off the roadway. Subsequent to an investigation, Burke was placed under arrest at which time he became uncooperative and spat in the face of a Deputy. Burke was charged with the following: -(1) Count NYS VTL 1192(2aa) Aggravated Driving while Intoxicated, with a .18% B.A.C. or higher, an unclassified Misdemeanor.-(1) Count of Harassment in the 2nd degree a violation. -Several other traffic violations and misdemeanors.
Burke was transported to the Kurt B. Wyman Law Enforcement Building for processing where he was released on appearance tickets returnable to Marcy Town Court at a later date.
